Platform Availability and Service Interruptions
The Platform may experience temporary or permanent service interruptions, and access to the Services may be unavailable from time to time. We do not guarantee continuous, uninterrupted, or secure access to the Platform. You acknowledge that such interruptions may occur due to technical issues, maintenance, regulatory actions, or circumstances beyond our control.
No Warranties
The Platform and Services are provided on an "as is" and "as available" basis without warranties of any kind. We and our Collaboration Partners expressly disclaim all representations and warranties, whether express, implied, statutory, or otherwise, including but not limited to: Implied warranties of merchantability, fitness for a particular purpose, title, or non-infringement Warranties arising from course of dealing or usage of trade Any warranty that the Platform will meet your requirements or expectations
We make no warranty or representation that:
The Platform will function without interruption, errors, or security vulnerabilities
Any defects, errors, or bugs will be corrected in a timely manner or at all
The Platform is free from viruses, malware, or other harmful components
Your data or digital assets will remain secure, accessible, or free from loss or corruption
Results obtained from using the Platform will be accurate, reliable, or suitable for your purposes
Third-party content or services integrated with the Platform meet any particular standards
Decentralized Protocol Nature
The Platform operates through smart contracts deployed on public blockchains. While the initial code may have been developed by other contributors, no single entity owns, controls, or operates the Platform. Protocol upgrades and modifications are managed through decentralized governance by vLAYERK Token holders. The decentralized and autonomous nature of the Platform means that no party can guarantee its performance, security, or continued operation.
Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW: No developer, contributor, service provider, or entity involved in creating, deploying, or maintaining the Platform (including LAYERK and our Collaboration Partners) shall be liable for any claims, damages, or losses whatsoever arising from or related to:
Your use of or inability to use the Platform or Services;
Your interactions with other users or third parties through the Platform;
Any unauthorized access to or alteration of your data or digital assets;
Any interruption, suspension, or termination of the Platform.
This limitation applies to all forms of damages, including but not limited to direct, indirect, incidental, special, exemplary, punitive, or consequential damages, and loss of profits, cryptocurrencies, tokens, digital assets, data, or any other items of value, regardless of the legal theory (contract, tort, negligence, strict liability, or otherwise) and whether or not we have been advised of the possibility of such damages.

YOU EXPRESSLY ACKNOWLEDGE AND AGREE that you use the Platform entirely at your own risk. You are solely responsible for determining whether any transaction or use of the Services is appropriate for you based on your personal objectives, financial circumstances, and risk tolerance.
